These General Conditions regulate the use (including mere access) of the website www.rda.pt, including the contents and services made available therein.

The User who accesses www.rda.pt acknowledges and accepts the General Conditions as well as the Terms and Conditions that are currently in force.

The contents and services that RdA Climate Solutions makes available to the User on www.rda.pt may also be regulated by specific conditions which, in the event of conflict, will prevail over the General Conditions. The User, each time he/she uses each Content or Service, also acknowledges and accepts the corresponding applicable Special Conditions.

The User must read the General Conditions carefully each time he/she wishes to use www.rda.pt, as well as, if necessary, the corresponding Particular Conditions, each time he/she wishes to use each Content or Service.

RdA Climate Solutions reserves the right to modify, at any time and without prior notice, the presentation and configuration of the website www.rda.pt, as well as these General Conditions or the corresponding Specific Conditions.

Use of the Website www.rda.pt

Unless otherwise indicated, the use of www.rda.pt will be free of charge, without prejudice to the cost of connecting to the corresponding electronic communications network through which the user has access to it.

The user is aware and accepts, voluntarily and expressly, that the use of www.rda.pt is always carried out under his/her sole and exclusive responsibility.

When using www.rda.pt, the user undertakes not to perform any act that may harm or damage the image, interests and rights of RdA Climate Solutions or third parties, or that may harm, damage, render useless or overload the website or that prevent, in any way, the normal use of www.rda.pt.

The User agrees by this Agreement to release RdA Climate Solutions from any liability that may result from the use of links that appear on the Service.

a) Hyperlinks The establishment of the Hyperlink does not imply, under any circumstances, the existence of relations between RdA Climate Solutions and the owner of the web page on which the Hyperlink is established, nor the acceptance or approval by RdA Climate Solutions of its contents or services.

RdA Climate Solutions reserves the right to prohibit or disable any hyperlink to www.rda.pt at any time, especially in cases where the activity or content of the website in which the hyperlink is included is unlawful.

Personal Data

RdA Climate Solutions may request some personal data from the User. RdA Climate Solutions will provide the User with the necessary information so that, in advance, they can expressly give their consent to the processing of their personal data for one or more specific purposes by RdA Climate Solutions.

The data collected is processed automatically and is intended to establish the quality of User/Client, consequent future contacts, namely, direct marketing actions, offering of accessory products and services related, even indirectly, to the activity of RdA Climate Solutions.

The data collected is also intended for compliance with legal obligations and for use in contractual relationships, with RdA Climate Solutions undertaking to maintain strict confidentiality regarding all data, reserving access to them to that which is exclusively necessary for its normal activity.

In case of default by the user, the data may be passed on to third parties for the purpose of debt collection.

The respective holder is guaranteed, in accordance with the national and international legislation in force (in particular Law 67/98, of 26 October and Regulation (EU) No. 2016/679, of 27 April 2016) the right to access, rectify, erase, limit or oppose processing as well as the right to the portability of personal data.

RdA Climate Solutions will only contact the User through any online/electronic means/device when the User has, in advance, expressly provided his/her consent.

General Provisions

The non-exercise, or the late or partial exercise, of any right that assists RdA Climate Solutions under this Agreement or any applicable provision, does not imply a waiver of such right, does not prevent its subsequent exercise and cannot constitute any form of delay or novation.

This Agreement constitutes the entire agreement between the User and RdA Climate Solutions, with respect to the subject matter regulated herein.

Changes to the Terms of Use

These terms of use may be updated at any time by RdA Climate Solutions without prior notice to Users, in order to respond to legal requirements or changes in operation. The User will always have access to the current online terms of use.

This document will always be available online and can be consulted freely and saved or printed at any time, even without being registered on the site.

Any changes will be communicated to registered Users via online posting.

Subsequent access and use of the website by the User will be considered as an unequivocal sign that the User has read, accepted and understood the amended Terms and Conditions, unless they imply a change in the personal data processing policy by RdA Climate Solutions, in which case the User will be required, in advance, to expressly authorize the change in the processing or purposes of processing personal data.

Partial Invalidity

The invalidity, in whole or in part, of any of the clauses of these General Conditions shall not affect the validity of the remaining provisions, which shall be applicable to their full extent, unless the interested party demonstrates that the purpose pursued by the parties allows us to suppose that they would not have concluded the transaction without the defective part.

Applicable Law/Jurisdiction

These General Conditions are governed by Portuguese law.

Final Provisions

All persons wishing to make purchases on this website declare that they are of legal age and have the legal capacity to do so.
